Please read these terms of use carefully before using the products and services of Otelyon Technology. Institutions and individuals using our services are deemed to have accepted these terms.
1. Parties and Scope
These terms of use govern the relationship between Otelyon Technology ("Company") and the natural or legal persons using Otelyon's products and services ("User"). The scope covers the products Otelyon Butler, Workflow, Staff PWA, AI Chat, QR Menu, POS Mobile, and POS Kiosk.
2. Service Description
Otelyon provides software services (SaaS) for the hospitality industry. Services include:
- Guest request and ticket management system (Butler)
- Hotel operations and department management system (Workflow)
- Mobile staff application (Staff PWA)
- AI-powered guest communication system (AI Chat)
- Digital menu and self-service systems (QR Menu, POS)
3. User Obligations
By using Otelyon services, the User accepts and undertakes the following:
- To access the system only within the permissions assigned to them
- Not to share account credentials (username, password) with third parties
- Not to make any attempt to damage the system, exploit it for misuse, or gain unauthorized access
- To access data stored in the system only for service purposes and not to disclose such data
- To comply with all applicable legislation, in particular Law No. 6698 (KVKK)
- That content uploaded to the system (photos, text, etc.) complies with copyright and legal requirements
4. Service Usage Rights
Otelyon grants the User a non-exclusive, non-transferable, personal right of use to access its services. This right:
- Does not cover copying, reproducing, or licensing the service to third parties
- Does not permit reverse engineering of the software
- Is valid only for the duration of the agreement
5. Intellectual Property
All software, design, graphics, logos, content, and materials belonging to Otelyon products are the property of Otelyon Technology and are protected by copyright and intellectual property laws. The User may not reproduce, distribute, or use these materials for commercial purposes without the Company's written permission.
6. Service Continuity and Maintenance
Otelyon takes the necessary technical measures to ensure uninterrupted service; however, service interruptions may occur in the following situations:
- Planned maintenance and update work (announced in advance)
- Unforeseeable technical failures or outages caused by infrastructure providers
- Natural disasters, cyberattacks, or force majeure events
Otelyon cannot be held liable for direct or indirect damages that may arise due to service interruptions.
7. Data Security and Privacy
The processing and protection of User data is governed by our Privacy Policy. Otelyon does not sell User data to third parties or use it for marketing purposes.
8. Pricing and Payment
Service fees are determined in the service agreement signed between the User and Otelyon. General principles:
- Monthly or annual subscription models apply
- A discount may be applied for annual payment preference
- Service may be suspended in the event of payment delays
- Setup and integration fees are separately specified in the agreement
- Price changes are notified to the User at least 30 days in advance
9. Termination
Either party may terminate the service agreement under the following conditions:
- By the User: With written notice at least 30 days before the contract end date
- By Otelyon: In case of a breach of the terms of use, with prior notice, or immediately in cases of serious breach
- After termination, User data is retained for the retention periods specified in the Privacy Policy
10. Limitation of Liability
Otelyon's liability is limited to the conditions set out in the service agreement. The Company is not responsible for damages arising from user error, third-party service outages, or force majeure. In any case, Otelyon's total liability cannot exceed the subscription fees paid for the last 3 months.
11. Changes
Otelyon may update these terms of use from time to time. Changes become effective from the date they are published on the website. The User's continued use of the service constitutes acceptance of the updated terms.
12. Governing Law and Dispute Resolution
These terms of use are subject to Turkish Law. In the event of disputes between the parties, negotiation will be attempted first; if unresolved, Istanbul Courts and Enforcement Offices shall have jurisdiction.
